TERMS OF SERVICE
If you have a problem with any of these terms, they may be changed if discussed with me before paying for your commissioned piece.
GENERAL TERMS

-
You can commission me for a variety of things! Including: portraits of people and/or animals, character/monster designs (original, RPG, etc.), banners, logos, and fan-art.
-
Anything NSFW (Not Safe For Work) will have an additional charge of up to $100 based on extremeness - any commission that I deem "too extreme" will be refused.
-
All drawings may or will include a subtle sign you may not remove.
-
I might record the drawing process and post it on my socials.
-
Prices are subject to change based on demand.
-
I accept commissions for commercial use, the price will be discussed over email depending on the purpose .
-
I reserve the right to refuse any commission that make me uncomfortable.

1. PAYMENT

-
The currency accepted is USD and can be paid through: PayPal, Cashapp, Bank Transfers.
-
Payments: either 100% upfront or split 50% upfront and 50% after the final update is approved (payment made before receiving the final image file).
-
Don't pay me before I agree to give you a slot and request you to send me the payment.
-
Any banner, logo, or design for commercial use as well as any commission that requires less than 2 weeks will be subject to a custom quote - DM (Direct Message) for further details.
-
If you DON'T want to pay for a background, then I will leave it transparent.
-
Simple backgrounds (1 color) = $5
-
Prices vary based on complexity (the above are BASE prices); I MAY CHARGE YOU MORE if the character / background is more detailed; however, we will talk about it and come to an agreement.

2. PROCESS AND DELIVERY

-
I will notify you when I start your commission - you will, therefore, lose the rights to a refund (see point 6 down below for more info)
-
While working on your commission, I will update you to ensure the piece is how you want it!
-
The amount of inspections depends on the complexity of the work.
-
During these inspections, you will see work-in-progress updates - these images will include a watermark and be smaller than the finished piece.
-
Please allow 2 weeks - 2 months until the commission is done - depending on factors such as health, the complexity of the commission, and other work reasons.
-
If anything comes up that will slow the progress of the initially estimated delivery time, I will let you know asap.
-
Be patient and mindful that this is a process. Open communication will allow things to go smoothly and quickly!
-
Once the final update is approved and the final payment is received, you will receive the full-resolution image with a web-friendly size. Note that there is no physical product. Depending on where you live, we can arrange to print your artwork. Just ask :)

3. REVISIONS

-
You get 3 rounds of changes on the commissioned piece included in the price - major revisions are only allowed during the sketch phase, and minor changes are permitted after the sketch is approved.
-
A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
-
If you want me to change something in the drawing you have previously approved (any major revisions), I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is based on an hourly wage.
-
If your reference is unclear, changes will come at an extra charge.

4. COPYRIGHT / USAGE POLICY

I, El Chango Mango, claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
-
Promote me with it everywhere
-
Publish books with it (art-books, etc.)
-
Display it everywhere to my liking (website, social media, etc.)
-
Post it wherever I want
The buyer is allowed to:
-
Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
-
Print the artwork and claim the character(s) as their own, not the artwork itself.
-
Use the artwork to promote themselves. You're not forced to give me credit when you post it, but it is appreciated.
The following is considered copyright infringement:
-
Reproducing/using the copyrighted artwork commercially - means making money off it in any way.
-
Claiming the artwork as your own
-
Removing my signature from the artwork
-
Altering the artwork without my consent
I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for non-personal use may be purchased at any time).

5. CUSTOMER SATISFACTION

-
I will do everything I can to make you, the customer, happy!
-
If you have a problem with anything regarding the commissioned piece please tell me asap so we can find a solution together.
-
I'm willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.

6. REFUND / CANCELLATION POLICY

-
The buyer is not allowed a refund once I start working on the commission.
-
If, for any reason, I am unable to start your commission, you will receive a full refund.
-
If you cancel your order before I start it, you can get a full refund.
-
If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.
-
If you request a PayPal chargeback at any point when you were not allowed to ask for a refund, you will lose all the above rights to the commissioned piece, and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

If the buyer breaks any of the points stated above - they will lose all the mentioned rights to the artwork commissioned by me, El Chango Mango, and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me before paying your commissioned piece.
